Maine Rx Program Still Standing Caregiving Resource Center On-line/Thou Shalt Honor Foundation

Recently consumers won the first round of a battle in Maine when the Supreme Court upheld a law adopted in 2000 called the “Maine Rx Law.” The program provides for discounts on prescription drugs for poor and uninsured persons. In a law suit against the state, drug industry representatives claimed that the program was in violation of the Medicaid laws and also in violation of the U.S. Constitution because it interfered with interstate commerce. The Maine program has not been endorsed by Secretary of Health and Human Services Tommy Thompson, and the court ruling did leave the door open for future attacks against the program.
